Terms of service
TERMS AND CONDITIONS
These Terms and Conditions ("Agreement") are entered into by and between SolarAdmin Ireland ("Service Provider") and the PV Installer/Company ("Client") collectively referred to as the "Parties".
1. Services
The Service Provider agrees to provide services to the Client related to the preparation and submission of PV solar grant applications, which include but are not limited to NC6 applications and SEAI grant applications ("Services").
2. Client Obligations
The Client agrees to provide all relevant images, documents, and paperwork necessary for the completion of the grant applications within two weeks of placing their order. The Client acknowledges that the Service Provider cannot commence or complete the Services without this necessary information. The Client agrees to provide access to the PV Installer's SEAI grant portal either by adding SolarAdmin Ireland as an administrator or by providing the login details to SolarAdmin Ireland.
3. Non-Refundable Services
Once work has commenced on grant applications, the Services become non-refundable. Evidence of the work commenced will be visible on the Installer's SEAI portal. The Client acknowledges and accepts this non-refundable policy.
4. Confidentiality
The Service Provider acknowledges that it will have access to certain confidential information pertaining to the Client's customers and grant portal login details. The Service Provider agrees to not disclose or use any such information, either during the term of this Agreement or thereafter, except as required in the course of providing the Services. All customer information shall be treated as strictly confidential and shall not be disclosed to any third party without the explicit written consent of the Client.
5. Data Protection
The Service Provider agrees to comply with all applicable data protection and privacy laws and regulations in the course of providing the Services. The Service Provider will implement appropriate technical and organizational measures to protect the personal data against unauthorized or unlawful processing, accidental loss, destruction, or damage.
6. Warranty
The Service Provider represents and warrants that it will perform the Services using reasonable care and skill and in accordance with generally recognized commercial practices and standards.
7. Limitation of Liability
Except in cases of willful misconduct or gross negligence, the Service Provider's liability under this Agreement shall be limited to the amount paid by the Client for the Services during the 12 months preceding the event giving rise to the liability.
8. Indemnification
Each party agrees to indemnify and hold harmless the other party against all claims, losses, costs, and expenses (including attorney fees) related to the breach of this Agreement.
9. Term and Termination
This Agreement shall commence on the date it is executed and continue until terminated by either party with a notice period of 30 days.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Ireland.
By accepting these terms and conditions, the Client agrees to the use and processing of their customers' data for the sole purpose of providing the Services as defined in this Agreement.
This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, and negotiations.
